Entwistle & Cappucci LLP Appointed Co-Lead Counsel in Emisphere Technologies, Inc. Securities Class Action

Entwistle & Cappucci LLP is pleased to announce that on January 19, 2024, the United States District Court for the District of New Jersey appointed Entwistle & Cappucci LLP as Co-Lead Counsel in the securities class action against Emisphere Technologies, Inc. (“Emisphere”).

The action alleges that Defendants artificially depressed the price of Emisphere common stock from November 6, 2020 through December 8, 2020 in order to ensure that the merger (“Merger”) of Emisphere and Novo Nordisk A/S would be consummated.  To implement the scheme, Defendants allegedly made a series of materially false and misleading statements and omissions of material facts concerning the Merger to the investing public.

The parties have entered into a scheduling stipulation, subsequently ordered by the Court, designating that a consolidated complaint will be filed on or before by April 22, 2024 and the anticipated motion to dismiss will be fully briefed by September 19, 2024.
